Last updated October 1, 2026. Plain language on purpose. The things that matter most are near the top.
These terms are an agreement between Orrin Broberg LLC, the Minnesota company that makes Prelude ("Prelude," "we," "us"), and the organization that uses Prelude to hire ("you," "the customer"). By signing in to Prelude, or by letting someone in your organization do so, you agree to them. If you're a candidate, these terms aren't aimed at you; our privacy policy explains how we treat your information.
If you have a signed agreement with us, such as a design partner or pilot agreement, that agreement wins wherever the two differ.
Prelude is a tool for hiring salespeople. It interviews the hiring leader about a role, builds a hiring profile from that interview, interviews candidates against the profile, and shows the leader a written read of each candidate with the reasoning and the candidate's own words. It also produces working documents from the profile, such as an interview plan and a job posting.
Prelude informs hiring decisions. It does not make them, and it must not be used as if it does. A person on your side reads the results and decides. Prelude's output is one input among the others you'd normally use, and it's only as good as the interview the leader gives it.
Accounts are set up by us or by your organization's administrator. Keep your password to yourself, use your real name and a work email, and tell us right away if you think an account has been misused. You're responsible for what's done under your organization's accounts.
Use Prelude only to hire for real roles in your own organization or, if you're a consultant or partner, for clients who've agreed to it.
Tell every candidate, before they begin, that the interview is conducted by an AI tool and recorded, and obtain any consent your jurisdiction requires. Prelude's interview opens with a notice and a confirmation step, but the legal duty to notify candidates is yours, and some places (Illinois, New York City and California among them) have their own rules about AI in hiring that apply to you as the employer.
Offer a typed alternative to any candidate who asks for one or needs one, and make any other accommodation the law requires. Prelude supports typed interviews.
Never use Prelude, or anything it produces, to decide based on age, sex, gender, race, ethnicity, national origin, religion, disability, pregnancy, family status, sexual orientation or any other protected characteristic. Prelude is built not to reason from these, and you agree not to either.
Don't use Prelude to interview anyone under eighteen, don't upload information you don't have the right to upload, don't try to copy, reverse-engineer or scrape the service, and don't use it to build a competing product.
Everything you put into Prelude, and everything it produces for you (profiles, transcripts, assessments, plans, postings), belongs to you. We process it only to run the service for you, as described in the privacy policy, and we don't use it to build anything for another customer. You can export it while your account is active and ask us to delete it when you leave.
Prelude itself, including its software, methodology, interview design, competency definitions, prompts and documentation, belongs to us. These terms give you the right to use it; they don't give you any ownership of it. If you give us feedback or suggestions, we can use them without owing you anything, and we'll happily give credit where it's due.
We'll keep your roles, profiles, candidates and business information confidential, and you'll keep confidential anything non-public you learn about Prelude, including features that aren't released yet. Neither side will share the other's confidential information except as needed to run the service, as required by law, or with the other's permission.
Prelude is priced per role: one hiring profile and all the candidates interviewed for that seat. Pricing is set out on your order or agreement. If you're using Prelude under a design partner or pilot arrangement at no charge, that's the fee until we agree otherwise in writing.
Prelude is a young product that's improving quickly. Features will change, usually for the better, sometimes with little notice. We'll keep the service running and tell you ahead of time about any change that affects your data or how you work. We may suspend an account that breaks these terms, after telling you why if we can.
Prelude is provided as it is. We don't promise that any candidate it rates well will succeed, that any it rates poorly would have failed, or that it will catch everything a human interviewer would. Hiring is a judgment, and the judgment is yours. Except where the law says otherwise, we make no warranties, express or implied, including fitness for a particular purpose.
To the extent the law allows, neither of us is liable to the other for indirect, consequential or punitive damages, or for lost profits, arising from these terms or from using Prelude. Our total liability to you for everything arising out of these terms is limited to the fees you paid us in the twelve months before the claim, or one thousand dollars if you've paid nothing. These limits don't apply to a breach of confidentiality, to misuse of the other side's intellectual property, or to anything the law won't let us limit.
You'll defend us against claims that arise from your use of Prelude in violation of these terms or of the law, including a failure to give candidates the notices and consents the law requires. We'll defend you against claims that Prelude itself, used as intended, infringes someone's intellectual property.
Either side can end it at any time by telling the other in writing. When it ends, your access stops, you can export your data for thirty days, and we delete it on the schedule in the privacy policy. The sections on data ownership, confidentiality, what we don't promise and limits on liability survive.
These terms are governed by the laws of Minnesota, and any dispute goes to the state or federal courts in Hennepin County, Minnesota, unless we both agree to settle it another way. If a court finds part of these terms unenforceable, the rest still stands. These terms, plus any signed agreement and the privacy policy, are the whole agreement between us. We may update these terms; if the change matters, we'll email you before it takes effect, and continuing to use Prelude after that means you accept it.
